General

The information on this website applies in Australia only.

By entering or using this website, you agree to read, understand and comply with our (ChezArt & Designs) Website Conditions (comprising Terms of Use, Customer Terms and Conditions and Privacy Policy), and any updates or revisions and further conditions notified to you. When you order products from ChezArt & Designs, you acknowledge that you have read the terms and conditions in detail and agree to be bound by them.

Using This Website

You undertake to use this website for your own personal (non-commercial) use, complying with the Website Conditions, to purchase ChezArt & Designs products and services. Information you submit on the website must be accurate and lawful (that is, would not give rise to criminal or civil proceedings) and must not disable or disrupt the operation of this website in any way.

Prices

All dollar amounts shown on this website are in Australian currency.

All product prices quoted include packing and shipping and are GST inclusive.

ChezArt & Designs reserves the right to change pricing at our discretion and without notice. Prices will not be changed on unfulfilled orders.

Payment

Payment

ChezArt & Designs accepts Mastercard, Visa, Amex, Apple Pay and Google Pay.

ChezArt & Designs is a Shopify supported store. If you pay using the Shopify Shop Pay app, your details will be saved for all future purchases.

Production and Delivery Lead Times

You acknowledge that ChezArt & Designs products are manufactured to order and that production will take 1-2 weeks from placement of order. Delivery through Australia Post or our nominated couriers will take a further 3-10 days, subject to Covid-19 restrictions applying at the time of shipment, and to your response time to any enquiries regarding your order. 

Generally, you should allow 3 weeks from placement of order to receipt of item.

Please note that for purchases required to be delivered before Christmas, for long haul (interstate) deliveries orders must be placed by mid November. Orders for delivery in NSW before Christmas must be placed by 1 December.

Colours

While reproduction of colours is as accurate as possible, there may be very slight variations between colours shown on this website and the product delivered to you. All screen settings are different, and the colours displayed on your screen may differ slightly to the final printed product. You agree that ChezArt & Designs does not guarantee that the final colours of your purchased product will be identical to those shown on your computer/tablet/phone screen.

Returns and Refunds

Our prints very rarely suffer manufacturing defects and are carefully packaged for shipping in custom designed packaging, so you can order with confidence.

In the unlikely event a product arrives showing a manufacturing defect, or if a product is damaged in transit ChezArt & Designs will quickly replace it. You agree that if a defect or damage occurs, you will take a photograph of the broken or damaged product and email it with your order number to support@chezart.com.au  On receipt of a returned product or photograph, ChezArt & Designs will send a replacement of the product  or will issue a credit in your ChezArt & Designs account for repurchase.

Refunds

Under Australian law, refunds are only offered if you experience a major problem, defined as:

• A problem that would stop someone from buying the product if they knew about it
• The problem makes the product unsafe
• If the product differs significantly from the sample or description
• It does not perform as the seller promised and cannot easily be fixed

Under the law you may seek compensation for damages and losses you suffer due to a problem with a product if we could have reasonably foreseen the problem. This is in addition to a replacement or credit. ChezArt & Designs is not responsible for damages or losses that are not caused by our conduct or our products or that relate to an event independent of our business after the goods leave our control.

You agree that whether a product’s failure or breakage is due to a manufacturing defect is solely at the discretion of ChezArt & Designs.

Cancellation or Changes to Your Order

You agree that you have carefully reviewed the product details before placing your order. ChezArt & Designs is not able to alter the product or quantity of your order or cancel your order once it has been placed.

Alteration to Delivery Address

You acknowledge that it is your responsibility to enter the correct delivery details when placing your order. If you require a delivery address update, we will endeavour to do this for you if the order has not yet shipped. We cannot change the delivery address once an order has been shipped, and at this stage it becomes the responsibility of the customer to ensure that you receive the order, or to place a new order.

ChezArt & Designs cannot be held liable if our customers omit any important information from the delivery address, resulting in the order being returned to ChezArt & Designs. If your order is returned to us due to customer error, you may be charged a delivery fee to reship your order.

Change of Mind

If you change your mind, or a ChezArt & Designs piece does not fit your space, please email us at support@chezart.com.au and we can work out an exchange for the right fit for you.

In addition to the rights granted by the applicable statute (including the Australian Consumer Law), if you change your mind you may return the product within 7 days of the date of delivery, provided the product is returned in its original condition, in its original, unopened and sealed packaging, and is accompanied by proof of purchase.

Consumer Guarantees

ChezArt & Designs products are supplied with guarantees which apply under Australian Consumer Law. ChezArt & Designs warrants that the goods will be supplied using reasonable care and skill. The life of the goods will vary depending on the environmental conditions. You acknowledge that the expected life of ChezArt products will be adversely affected if they are subjected to direct or strongly reflected sunlight and/or high temperatures.

Collecting Personal Information

Where this Privacy Policy refers to Personal Information, it refers to any information which can uniquely identify a person. We collect personal information about your device, your interaction with the site,  information necessary to process your purchases, and additional information of you contact us for customer support.

We disclose your personal information as necessary for business purposes to suppliers with whom we partner to process, manufacture, deliver, receive payment for, and invoice your orders. Personal Information comprises:

We collect your web browser version, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the site. This information is collected automatically using current standard technologies (cookies, log files, web beacons, tags or pixels) to load the site accurately for you, and to perform analytics on site usage to optimise our site.

Order Information

Through your interactions with us on our website, or by phone, we collect your name, billing address, shipping address, payment information, email address and phone number to fulfill our contract to provide products or services to you, to process your payment, to arrange for manufacturing and shipping, and provide you with invoices, order confirmations, screen your orders for potential risk of fraud, and provide you with product and services information or advertising in line with the preferences you have shared with us.

Customer Support Information

Customer support information includes the above personal device and order information, and any additional personal information needed to provide first class customer service and resolve issues.

If you create an account with us, to maintain a secure, functional account will require a password. You will have full access to your data and will control how we communicate with you. We may also collect feedback, comments and questions received from you in service-related communications including phone calls, documents, and emails.

Behavioural Advertising

We may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you, including Google Analytics, Adwords and Facebook. How We Share and Protect Your Personal Information

Any personal information you provide to ChezArt & Designs will not be released, sold, or rented to any person or entity outside ChezArt& Designs. We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you. For example, we use Shopify to power our online store. All credit card transactions are conducted through SSL encrypted links between Shopify’s servers and your computer, securing the transaction. In the extremely unlikely event that your credit card data is compromised, we will inform you immediately.

We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Retention

We may keep your Personal Information for a reasonable time after your last transaction with us. When the Personal Information is no longer required to answer queries, resolve possible problems, to comply with legal requirements, and to deal with problems, claims or complaints, we will delete it in a secure manner.

While this website may be accessed in Australia and throughout the world, ChezArt & Designs makes no offer in or via this website to sell any product in any country outside Australia. This website has been designed for use within Australia and the laws of New South Wales shall be the applicable law.

At this point in time we do not offer international delivery, but we are happy to consider options and quote on a case by case basis. If you are outside Australia and would like to enquire about our artworks, please contact us via our contact page.
